Two-Owner Property

Two Owner

Copies of bona fide purchaser warranty deeds of record and/or 24-month chain. If two owners do not provide 24-month chain, we will go back another bona fide deed. (Quit Claim Deed, Interfamily Deed, Interspousal Deed, and Contract for Deed do NOT satisfy this requirement). If a party in the chain of title has not conveyed his/her interest by way of written instrument, we will search divorce & death records.

 

SECURITY INSTRUMENTS

Pertinent copies of unreleased mortgage/deed of trust/security instruments, UCCs and liens of record. Included will be any assignment or modification which relate to an unreleased instrument. If property is free & clear, a copy of last security instrument and its release.

 

JUDGMENTS & OTHER LIENS

Copies of any type of unreleased judgments of record including by not limited to Claims of Lien, Certificate of Tax Sale, Certificate of Forfeiture, Writ Fieri Facias, Writ of Seizure and Sale, Notice of Assessments, Paving Liens, Mechanics Liens, Lis Pendens, Federal & State Tax Liens, Assessments, Municipal Liens, etc.

 

Releases

Copies of any releases recorded in the last 12 months.

Name Search

A 20-year (product related) general index search on the names of the buyers, sellers and/borrowers. Perform the search using all variations of the names as well. Detail of all names, including variations, searched along with the time frame of the search. If a middle initial exists for any party, that name is also run without the middle initial. For females, no items should be eliminated based on middle initial.

 

CCRS

Itemized list of all easements, restrictions, covenants, conditions, agreements, leases, plats and surveys.

 

Additional

If there is any indication that the property is commercial or tribal land the search is to be placed on hold, and you are to be notified.
Should it be determined that the property is a mobile home, the Affidavif of Affixture or similar de-titling document will be provided. If no evidence of the title being surrendered is located, this will be reflected in the summary report.
